The Court of Criminal Appeal is due to rehear an appeal against the sentence handed down to Anthony Lyons.
The 52-year-old businessman, with an address at Griffith Avenue, was jailed for six months after sexually assaulting a woman near his home.
Anthony Lyons was sentenced to six years behind bars after he was found guilty of rugby tackling and groping a woman near his home in October 2010,
But the trial judge sparked a public outcry after deciding to suspend all but six months of that term and ordering him to pay 75 thousand euro in compensation.
Last November, the DPP successfully appealed his sentence on the grounds of undue leniency.
But before a decision was made on a more appropriate sentence, one of the sitting judges became ill and the appeal has to be heard again.
That's due to take place before a three judge panel today.
