A south county Dublin teenager has had his 3 year jail sentence for attempting to murder a 17 year old deferred ahead of an appeal.
Tadhg Costello from Richmond Hill, Monkstown stabbed Josh Leahy 6 times during a brawl near South William Street in May 2012
There was an unexpected reprieve for Tadhg Costello who was handed down a 3 year jail sentence for stabbing Josh Leahy 6 times in the back during a city centre brawl.
The 19 year old walked from court on bail surrounded by a large group of his friends after the judge made the unusual decision of deferring the activtion of his sentence for 3 weeks to allow the teenager apply for bail ahead of an appeal.
Costello pleaded guilty to attempted murder at his trial last November after the court ruled his garda statements could be put before the jury.
However a recent Supreme Court ruling could raise issues about the admissibility of the evidence.
In those garda interviews Costello said he'd sharpened the knife, carried it with him at all times and that he'd intended to kill Josh Leahy when he attacked him that night.
