A jury has failed to reach a verdict in the trial of a man accused of murdering a father of five in Tyrellstown in Dublin.
Michael Kinsella of Swiftbrook Close, Tallaght had denied killing Adel Essalhi over three years ago
Just before lunchtime today, the jurors were told they could return a majority verdict of at least ten to two.
They returned a few minutes after 3 o'clock and told Mr. Justice Paul Carney they couldn't agree on a verdict.
During the trial, the court heard how Adel Essalhi's scorched body was found in a ditch behind the Tyrellstown Plaza in January 2011.
A post mortem revealed he was beaten and stabbed up to 60 times before his body was bleached and set alight.
A machete, believed to be the murder weapon, was found near his body.
The jury was told that Michael Kinsella's uncle Wayne has already been found guilty of Mr. Essalhi's murder.
21-year-old Michael denied any involvement and after deliberating for almost five hours, the jurors were unable to reach agreement on a verdict.
Mr. Justice Carney then discharged the jury and the case will now go to a retrial.
