The Court of Appeal has thrown out Joe O'Reilly's attempt to have his conviction for the murder of his wife Rachel declared a miscarriage of justice.
It followed arguments by the DPP that the case was an abuse of process because it raised no new points of law.
The 42 year old is serving life for the murder of his wife Rachel who was bludgeoned to death at their home in the Naul in North Dublin in 2004.
Rachel's mother, Rose Callelly was happy with the ruling, but says she still hopes someday Joe O'Reilly will admit his guilt.
