Former businessman Breifne O'Brien has failed in an appeal to stop his upcoming trial on fraud and theft charges.
Mr O'Brien of Monkstown, Co Dublin is alleged to have operated a pyramid or ponzi type scheme for several years up to 2008.
He argued that he could not receive a fair trial because of adverse publicity.
However the Supreme Court has found that years have now passed since the bulk of that publicity.
