The High Court has approved an application seeking a judicial review of the demolition of the O’Rahilly house at 40 Herbert Road Dublin 4.
The building linked to 1916 leader Michael Joseph O'Rahilly was bulldozed in September for the development of over 100 apartments.
Residents from the Pembroke Road Association are raising money to have the review heard in court.
Local councillors hope it will find that the building had the protections of a protected structure.
Dublin City Councillor Daniel Céitinn says: "I welcome the news that the High Court has approved the application by the Pembroke Road Association seeking a judicial review of the planning application and demolition of the O’Rahilly house, 40 Herbert Park.
"Dublin City Council, on foot of a cross party Sinn Féin-Greens motion, voted two weeks ago deploring the demolition and demanding reconstruction of the historic building.
"The City Council had begun the process of listing the building on the record of protected structures. The building should have had the protections of a protected structure, and we are hoping that the judicial review will find that it did."
