Egged Dublin Nurse Loses Court Case

A Dublin nurse, who was partially blinded after she was ‘egged’ from a passing car in 2008, has failed in her legal action against the driver.

Ann Doody from Shankill needed to have an eyeball removed after a backseat passenger hit her in the face with an egg.

Ann Doody, a 46 year old mother of three, was out for a walk with her friends on the Bray Road on March 26th 2008.

An egg was thrown from a passing car and she heard somebody screaming “I hit her. I hit her” as it drove away.

She was forced to have her eyeball removed two years later.

The egg was thrown by then 17-year-old David Morgan who has already been dealt with by the courts.

Ms Doody sued the driver, Niall Clarke, for personal negligence claiming he should have exercised more control over his passengers.

But today, the High Court ruled that she placed an excessively high standard of care on the young driver and her action was dismissed.

Mr. Justice Kevin Cross accepted that while he was aware there were eggs in the car and a back window was rolled down, Clarke couldn’t be held liable for what he described as the “appalling” injury to the Dublin nurse.
